Applicability of these terms and conditions:
These terms and conditions are valid for every offer and every agreement between BoardFun and a consumer (hereafter called the Customer)
upon whom BoardFun has declared these terms and conditions applicable, so far as parties have not deviated explicitly and in writing from these terms and conditions.
The terms and conditions in question are also valid for agreements with BoardFun, in the execution of which third parties have to be involved.
Prices:
All prices stated on our website are including the higher rate of VAT, excluding delivery charges and are subject to change.
BoardFun.nl reserves the right to change prices, as required by market forces. BoardFun cannot be held to its quotation when
the Customer could have known that the quotation, or a part thereof, included a mistake or clerical error.
Offers:
All offers from BoardFun.nl are non-committal unless the opposite is explicitly stated in the offer.
Offers are valid for as long as items are available. Facts such as prices, specifications and pictures on the website or
on other Boardfun documentation are subject to change and are not binding for BoardFun.nl, unless these facts have
been explicitly agreed by both parties. BoardFun.nl will reply to questions within two working days by e-mail.
Special offers can not be exchanged.
Lead time:
Stated delivery times must not be considered as absolute unless this has been explicitly agreed otherwise.
BoardFun.nl shall, within reason, do all it can to ensure delivery at or within the agreed delivery time.
As soon as BoardFun.nl has knowledge of facts and/or circumstances which may make delivery impossible at or
within the agreed delivery time, BoardFun.nl will inform the Customer as soon as possible and will provide a new
estimated lead time. If BoardFun.nl cannot comply, as previously described, for a period of more than thirty (30) days, then the
Customer is entitled to cancel the agreement, unless this has been explicitly agreed otherwise.
(exchange) Warranty:
The Customer has a two year factory warranty on snowboards. Wakeboards, surfboards, skateboards, bindings and accessories have a warranty period of one year.
The warranty on clothing is guaranteed to the extend of which can reasonably be expected.
We give the Customer a three month warranty on test equipment (unless stated otherwise).
Our return and exchange warranty is simple; the Customer has the right to return items within fourteen days of purchasing an item from BoardFun.nl (except for special offers).
The Customer has the choice of a credit of the amount paid to BoardFun minus delivery costs, or BoardFun will exchange the item for
another chosen by the Customer. Any price difference will be settled. When sending the new item BoardFun will make another delivery charge.
A prerequisite for the above mentioned arrangement is that BoardFun receives the returned item undamaged and in its original packing.
The Customer should make clear why the item has been returned and enclose a copy of the bill. Please do not write on the products packaging !
BoardFun is not responsible for any damage during transit. The Customer will ensure the item, with its original packaging, is returned with
sufficient protective packaging. Boardfun has the right to make a charge against the amount to be credited if items returned are damaged.
The Customer will also ensure that enough postage has been placed on the item to be returned. BoardFun does not accept mail without or with

Delivery charges for items within their warranty period are the responsibility of the Customer. BoardFun is responsible for sending
items to the factory, if necessary, and the items will be returned to the Customer at the expense of BoardFun.
Special offers cannot be exchanged.
Circumstances beyond our control:
1. Circumstances beyond our control in these terms and conditions are, in addition to what is understood in law and jurisprudence, all external causes,
foreseen or unforeseen, on which no influence can be exercised by BoardFun, yet through which BoardFun is unable to meet its obligations, including strikes.
2. BoardFun also reserves the right to appeal to circumstances beyond their control when circumstances which prevent (further)
compliance occur after BoardFun should have met their obligations.
3. Boardfuns delivery and other obligations are suspended in the case of circumstances beyond their control. If the period during
which due to circumstances beyond their control Boardfun cannot meet their obligations lasts longer then two weeks,
then both parties are entitled to cancel the agreement without obligation of payment.
4. If BoardFun has already met part of their obligations when circumstances beyond their control occur, or can
only meet part of their obligations, than they are entitled to charge for the already delivered part or the deliverable part
separately and the Customer has to pay this bill as if it were a separate agreement.
This does not apply if the already delivered part or the deliverable part does not hold individual value.
Liability:
1. This website is intended to supply information to our customers. We have compiled the contents of this website
with the greatest possible care but cannot make any guarantees with regards to the nature or the content of the information
on this website. We are not responsible for the content of this information or for the effects of its usage. It is not permitted to "frame" this website.
We cannot be held responsible or liable for access to or the information on any website which is connected/linked to or from this website.
2. BoardFuns responsibility is limited to redelivering specific items, or restitution of the purchase cost.
3. BoardFun has effected an insurance which covers third parties for an amount which is customary in BoardFuns industry branch.
In the event of legal responsibility the Customers claim towards BoardFun is limited to payment by the insurance company in the case in question.
4. In the case of faulty equipment being supplied liability applies as in BoardFuns ´General Terms and Conditions´.
5. Above mentioned restrictions do not apply if damage is due to malice and/or gross fault and/or reproachable actions by BoardFun or her subordinates.
6. These terms and conditions are valid for every offer and every agreement between BoardFun and the Customer on whom
BoardFun has declared these terms and conditions applicable, so far as parties have not deviated explicitly and in writing from these terms and conditions.
